Considerations for Compliance Professionals After the Recent eClinicalWorks Settlement

eClinicalWorks (ECW), an EHR vendor, recently settled with the Department of Justice and the Office of Inspector General of HHS for $155 million and entered a five-year Corporate Integrity Agreement. The settlement was the result of an allegation that ECW had structured their Electronic Health Record in a manner that did not comply with the Office of the National Coordinator for Health Information Technology certification requirements to be a certified EHR appropriate for health care providers to use in attesting for meaningful use incentive payments. Data Protection Remains Shaky

Data remains exposed in significant numbers in the healthcare industry. The monthly Protenus Breach Barometer shows that the trend of at least one breach per day in a month is continuing. To be specific, Protenus and Databreaches.net showed 37 breaches being disclosed for the first time in May. The number is significant, demonstrating the ongoing challenge for the healthcare industry.
